Terms of Use for Tō3

These Terms of Use (“Terms”) are a legal agreement between you (“you”) and Rabbit Hole Apps (“we,” “us,” or “our”) for the Tō3 mobile application, related websites (including plan selection and billing pages), and services we provide in connection with Tō3 (collectively, the “Service”).

Tō3 provides live, full-duplex voice communication for events and crews.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.


1. Who we are

2. Eligibility

You must be at least 13 years old to use Tō3. The Service is not directed to children under 13, and we do not knowingly allow them to create accounts.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

These Terms work together with:

If there is a conflict about use of the mobile app, the EULA controls. If there is a conflict about privacy, the Privacy Policy controls. Otherwise, these Terms govern your use of the Service.

Your use is also subject to applicable Apple App Store or Google Play terms when you install the App from those stores.


4. Accounts

You need an account to use most features. You may sign in with Google or Sign in with Apple, as offered in the App.

You agree to:

  • Provide accurate profile information and keep it current.
  • Keep your device and sign-in credentials secure.
  • Notify us if you believe your account has been compromised.

You are responsible for activity under your account. You may delete your account in the App (Profile → Delete account). Deletion is permanent and may remove your profile, event participation data, and entitlements as described in the App and Privacy Policy.


5. User content

The Service lets you create and share User Content, including event titles, schedules, venue text, display names, invites, optional images, and participation in live audio sessions.

You retain ownership of your User Content. By submitting User Content or joining a session, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, and otherwise use that content only to operate, provide, secure, and improve the Service (for example, showing your display name in a room or routing audio through our infrastructure).

You represent that:

  • You have the rights to submit your User Content.
  • Your User Content does not violate law or third-party rights.
  • Your use of the microphone and participation in sessions complies with applicable law and any rules of the event or organization you serve.

Live audio is processed in real time. Unless we separately announce recording, do not assume sessions are recorded or stored by us for playback.

5.1 Acceptable use

You may not use the Service to:

  • Harass, threaten, impersonate others, or violate privacy or publicity rights.
  • Post unlawful, defamatory, hateful, or sexually explicit content.
  • Spam, scrape, or attempt unauthorized access to systems or accounts.
  • Interfere with live sessions or other users’ use of the Service.
  • Reverse engineer or misuse the App except where applicable law allows.

We may remove User Content or suspend or terminate accounts that violate these Terms, create risk, or are required by law.


6. Paid plans and billing

Some features require a paid plan (for example, Pro or Pro+ host limits).

Important: Tō3 does not sell subscriptions through Apple or Google in-app purchase at launch. You purchase on our website via Stripe using the same account you use in the App. The App reads your entitlement from our servers after payment.

6.1 Plans

We may offer:

  • Recurring subscriptions (for example, monthly, season, or yearly).
  • Day passes and other one-time purchases for limited-time access.

Prices and features are shown on our pricing page and in the App before you checkout.

6.2 Auto-renewal

Recurring subscriptions renew automatically until you cancel. You authorize us (through Stripe) to charge your payment method each billing period at the then-current price unless you cancel.

6.3 Cancellation and refunds

Cancel in our billing portal (linked from our website and the App as “Manage billing”):

Delete account: You may delete your account anytime in the App. Deletion forfeits any remaining paid time, immediately cancels active subscriptions, and does not entitle you to a refund for unused time. To keep access through the end of a monthly period without deleting your account, cancel in Manage billing instead.

Chargebacks and payment disputes are handled under Stripe and card-network rules.

6.4 Changes to pricing

We may change plan prices or features for new purchases. We will not reduce material paid entitlements during an active paid period without notice required by law. Price changes for renewals will be communicated as required by applicable law and Stripe’s policies.


7. Intellectual property

Tō3 and the Service — including software, design, text, graphics, logos, and trademarks (excluding your User Content) — are owned by Rabbit Hole Apps or our licensors and protected by intellectual property laws.

Tō3, Rabbit Hole Apps, and related marks are our property. You may not use our names, logos, or marks without our prior written permission, except as allowed by law or store guidelines.


We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to our designated agent:

Include the information required by the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), including:

  • Your physical or electronic signature.
  • Identification of the copyrighted work.
  • Identification of the material you claim is infringing and where it appears on the Service.
  • Your contact information.
  • A statement of good-faith belief that use is not authorized.
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act for the copyright owner.

We may remove reported content and terminate repeat infringers where appropriate.


9. Feedback

If you send suggestions, ideas, bug reports, or other feedback about the Service (“Feedback”), you agree we may use and implement that Feedback without obligation, attribution, or compensation to you.


The Service relies on third parties (for example, Google Firebase, LiveKit, Stripe, Google Places, and sign-in providers). Their terms and privacy policies apply to their processing.

The App may show branding for affiliated partners (for example, official apparel). Tapping partner branding may open an external website. That is not third-party advertising and we do not use ad networks in Tō3.

We are not responsible for third-party sites or services you visit from links in the Service.


11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

We do not warrant uninterrupted, error-free, or secure operation, or specific audio latency in all network conditions. Live voice depends on your network, device, and third-party infrastructure.


12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RABBIT HOLE APPS AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR TŌ3 PLANS IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50).

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.


13. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Rabbit Hole Apps from claims arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.


14. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms, create risk, or as required by law.

You may stop using the Service anytime and delete your account as described above. Provisions that by their nature should survive termination will survive.


15. Governing law and disputes

These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your residence apply.

You agree to try to resolve disputes informally by contacting us first. If informal resolution fails, disputes will be resolved in the state or federal courts located in Texas, unless applicable law requires otherwise.


16. Changes

We may update these Terms from time to time. We will post the updated version here and change the “Last updated” date. Material changes may be communicated through the App, email, or our website where required by law.

Continued use after changes become effective means you accept the updated Terms. If you do not agree, stop using the Service and delete your account.
