End User License Agreement for Tō3

This End User License Agreement (“Agreement”) is between you (“you” or “User”) and Rabbit Hole Apps (“we,” “us,” or “our”) for the Tō3 mobile application (“Tō3” or the “App”).

Tō3 provides live, full-duplex voice communication for events and crews — for example, hosts who open a live room, share a join code, and talk with listeners through the phone and headphones they already own.

By downloading, installing, accessing, or using Tō3, you agree to this Agreement. If you do not agree, do not use the App.

1. License grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use Tō3 on devices you own or control, solely for your personal, non-commercial purposes, and only as permitted by this Agreement and the applicable app store’s terms.

This license does not sell the App to you. We and our licensors retain all rights not expressly granted.

2. Restrictions

You may not, and you may not permit others to:

  • Sell, rent, lease, sublicense, distribute, transmit, host, or otherwise commercially exploit Tō3 or any part of it.
  • Copy or use Tō3 for any purpose other than your personal, non-commercial use as allowed under this Agreement.
  • Modify, adapt, translate, decrypt, decompile, reverse compile, reverse engineer, disassemble, or create derivative works of Tō3, except to the extent applicable law expressly permits despite this limitation.
  • Interfere with or disrupt live sessions, servers, or other users’ use of the App.
  • Use Tō3 to harass, abuse, impersonate others, or violate applicable law or third-party rights.
  • Remove, alter, or obscure proprietary notices, labels, or marks on or in the App.

3. App store terms

Tō3 is distributed through the Apple App Store and/or Google Play Store. Your use is also subject to that store’s terms and policies. If there is a conflict between this Agreement and required store terms, the store terms control only to the extent required for distribution on that platform.

  • Apple: Apple is not a party to this Agreement and is not responsible for Tō3 or its content. Apple has no obligation to provide maintenance or support for the App.
  • Google: Google is not a party to this Agreement and is not responsible for Tō3 or its content.

4. Accounts and sign-in

Tō3 requires an account. You may sign in with Google or Sign in with Apple, as offered in the App.

You are responsible for activity under your account and for keeping your device and sign-in credentials secure. Notify us promptly if you believe your account has been compromised.

5. User content and live sessions

Tō3 lets you create and participate in events, sessions, and related content (for example, titles, schedules, display names, invites, and participation metadata) (“User Content”). When you host or join a live session, the App uses your device microphone to send audio in real time.

You retain ownership of your User Content. By submitting User Content or participating in a session, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, display, and transmit that content only as needed to operate, provide, secure, and improve Tō3 (for example, showing your display name in a room or routing audio through our infrastructure).

You represent that:

  • You have the rights to submit your User Content.
  • Your use of the microphone and participation in sessions complies with applicable law and any rules of the event or organization you are serving.
  • Your User Content does not violate law or third-party rights.

We may remove User Content or suspend access that violates this Agreement, applicable law, or creates risk to users or the service.

Audio: Live audio is processed in real time to deliver sessions. Unless we separately announce a recording feature, do not assume sessions are recorded or stored by us for playback.

6. Subscriptions and paid features

Some Tō3 features require a paid subscription (for example, higher host or listener limits). Purchases are completed on our website (not inside the App’s in-app purchase flow). The App reads your entitlement status from our backend after you subscribe with the same account.

  • Billing is handled by Stripe on our website. Card and billing data you provide at checkout are subject to Stripe’s Privacy Policy.
  • Auto-renewal: Recurring plans renew automatically until you cancel through our billing management page (Stripe Customer Portal), linked from our website and described in the App.
  • Refunds follow our published refund policy and applicable store or payment-processor rules.

Free-tier limits, session caps, and feature availability may change; we will not reduce material paid entitlements during an active paid period without notice required by law.

7. Updates

We may update Tō3 with new features, bug fixes, security patches, and other changes. Updates may install automatically or require your action, depending on your device and store settings.

Continued use after an update constitutes acceptance of the updated App and, where applicable, an updated Agreement.

8. Feedback

If you send suggestions, ideas, bug reports, or other feedback about Tō3 (“Feedback”), you agree that we may use, implement, and incorporate that Feedback without obligation, attribution, or compensation to you.

9. Privacy

Tō3 collects personal information — for example, account identifiers, profile fields you provide, event and session metadata, optional push notification tokens, and diagnostic data.

Our privacy practices are described in the Tō3 Privacy Policy. By using Tō3, you acknowledge that you have read it.

10. Intellectual property

Tō3, including software, design, text, graphics, logos, and trademarks (excluding your User Content), is owned by Rabbit Hole Apps or our licensors and is protected by intellectual property laws.

Tō3, Rabbit Hole Apps, and related marks are our property. You may not use our names or marks without our prior written permission, except as allowed by applicable law or store branding guidelines.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TŌ3 IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted, error-free, or secure operation, low latency in all network conditions, or that defects will be corrected. Live voice depends on your network, device, and third-party infrastructure (including real-time audio providers).

Some jurisdictions do not allow certain warranty exclusions; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RABBIT HOLE APPS AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF TŌ3 OR ANY LIVE SESSION.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THIS AGREEMENT OR TŌ3 WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR TŌ3 SUBSCRIPTIONS OR RELATED SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50).

Some jurisdictions do not allow limitation of liability for certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Termination

This Agreement remains in effect until terminated. We may suspend or terminate your license or account if you breach this Agreement or if we discontinue the App.

You may delete your account in the App where that feature is offered. Upon termination, stop using Tō3 and delete all copies from your devices. Sections that by their nature should survive will survive termination.

If you have an active paid subscription, cancel billing on our website before or after account deletion as described in the App and Privacy Policy.

14. Changes to this Agreement

We may update this Agreement from time to time. We will post the updated version on this page and update the “Last updated” date above.

Your continued use of Tō3 after changes become effective constitutes acceptance of the revised Agreement. If you do not agree, stop using the App and uninstall it.
